SCOTUS Upholds FCC Ability To Levy Fines

With the U.S. Supreme Court’s rulings in Loper Bright Enterprises v. Raimondo and SEC v. Jarkesy, questions arose as to whether or not the Federal Communications Commission had the authority to impose financial forfeitures for violations of its rules.


The nation’s highest judicial body has spoken, and it has affirmed the FCC’s ability to levy fines. Yet, it also establishes that a party subject to a fine can effectively do nothing until a jury trial is heard.
