Federal Court Remands N.Y. AG Fight Against Sirius XM

One month ago, People Of The State Of New York, By Letitia James v. Sirius XM Radio Inc. was removed from New York State Supreme Court and assigned to the U.S. District Court serving New York’s Southern District, in Foley Square.


It is now known that the case won’t proceed on the federal level, and has been sent back to the State of New York’s court system.

 

Judge Jed Rakoff on February 22 granted a motion to remand the case back to New York court, marking a victory for the office of Letitia James, the Attorney General for the State of New York.

The Empire State wanted the case back in its own courts, and not at the federal level, which Sirius XM had desired. The remand motion was filed by James on January 31, just days after New York State Supreme Court pushed it up.

As James’ office sees it, Sirius XM engaged in “a deliberately lengthy and burdensome cancellation process,” basing its conclusions on an investigation that found SiriusXM “forces” its subscribers to call or chat online with an agent to cancel a subscription, then deliberately draws out those interactions as part of its strategy to prevent subscribers from canceling.
