In late August 2023, “Chuck The Radio Guy” struck an agreement to obtain two AM radio stations with FM translators and an FM sibling serving a region of Southwestern Virginia. Approximately 12% of the total dollars he agreed to pay the seller were provided ahead of closing; the remainder was honored via a Promissory Note.
Only, Chuck Marsh didn’t pay in a timely manner what he’d agreed to deliver to the seller, which in August 2025 took Marsh’s Blue Ridge Media Partners to court. Marsh countersued. Now, a settlement has been reached, and it will see a deal unwind after nearly three years.
As RBR+TVBR reported on September 1, 2023, Three Rivers Media agreed to sell to Blue Ridge Media Partners WYVE-AM 1280 and W260DI at 99.9 MHz in Wytheville, Virginia; and WLOY-AM 660, W277DS at 93.3 MHz, and WXBX-FM 95.3 in Rural Retreat, Va.
With James Browne signing off on the sale, it planned to earn $495,000 from the deal. A $25,000 escrow deposit has been made by Marsh. At closing, he paid $35,000. The remaining $435,000, plus interest, was to be honored by a Promissory Note.
Two years after the Asset Purchase Agreement was signed, however, Three Rivers filed a complaint against Blue Ridge in Wythe County, Va., Circuit Court, alleging breach of contract. On November 13, 2025, a counterclaim was filed in the court by Blue Ridge and Marsh.
Rather than duke it out in court, Marsh has agreed to return the properties (including two parcels of real estate) to Three Rivers. In exchange, Browne is extinguishing all outstanding debt claims against Marsh.
Additionally, Three Rivers has agreed to pay Marsh and/or Blue Ridge $25,000 — essentially a refund of its escrow deposit.
Three Rivers has already reassumed control of the stations via a Time Brokerage Agreement. WLOY airs a Classic Country format, while WYVE offers a current-focused Country presentation. WXBX is branded as “Kool” and airs a Classic Hits format.
