New Motion Filed In AT&T/Time Warner Trial

Late Tuesday afternoon, large programmers filed a motion to intervene in the AT&T/Time Warner trial — regarding the Justice Department’s lawsuit to block AT&T’s $85 billion takeover of Time Warner — in response to the ACA/RCN amici.


They are objecting to the proposal that parties to an arbitration involving Time Warner programming should have the right to access their programming contracts in discovery. They say such contracts contain highly confidential and competitively sensitive info, among other things.

In its lawsuit against the merger, the Justice Department has argued the new company would stifle competition and force customers to pay more.
