The FCC is asking for an amendment that would allow it to review additional evidence in support of the proposed modification of a FM radio station licensed to Umbarger, Tex., a hamlet of 330 people southwest of Amarillo.
Top O’Texas Educational Broadcasting Foundation Inc., licensee of KIJN-FM in Farwell, Tex., seeks a minor modification of its facilities and a change of its community of license.
The application proposes to relocate KIJN-FM’s transmitter site to a new tower location, height and effective radiated power and to change the station’s city of license from Farwell to Umbarger, making it the community’s second local service.

It’s asking Top O’Texas to amend the application to provide additional evidence in support of the proposed modification.
Several priorities must be taken into consideration for the Bureau to decide on the matter.
First, the application, as submitted, does not satisfy the requirements of Priority (2) of
the Commission’s allotment priorities because it does not propose a second full-time aural service at the move-in community, Audio Division Chief Al Shuldiner said.
“Likewise, the Application does not satisfy the requirements of Priority (4), other
public interest matters, absent further, more detailed information, including evidence of the actual effect on the public interest of the proposed move,” he added.
Additionally, Shuldiner pointed to section 73.3564 of the FCC’s Rules, which states that “[a]pplications with uncorrected tender and/or acceptance defects remaining after the opportunity for corrective amendment will be dismissed with no further opportunity for amendment.”
Thus, a letter sent to the licensee by Shuldiner serves as its opportunity to fix the problem, and Top O’Texas has 30 days from December 20 to do so.
