The FCC dismissed an application for review filed by Royce International Broadcasting Company concerning KUDL(FM), Sacramento.
The Media Bureau had earlier granted assigning KUDL’s license from Royce to Entercom.
Royce had appealed the grant in 2005, first to the bureau and then to the full commission.
In 2003, the bureau determined the sale complied with its local ownership rules and Entercom closed on the acquisition. But then the agency instituted new processing guidelines and Royce argued the grant should be re-processed under the revised local ownership processing rules and its petition was pending.
The bureau didn’t agree then and the full commission upholds that decision now; that Royce failed to demonstrate the bureau made a mistake. The commission says Entercom had an existing combo that was grandfathered by the ownership order and the bureau correctly applied the processing rules.
