He first petitioned the FCC in February and in June submitted an amended petition that would amend FM broadcast spacing rules for the U.S. Now, the Media Bureau is seeking comment on what Charles M. Anderson is seeking.
Anderson wishes to amend section 73.215 of the Commission’s rules by adding subsection (f) to allow exceptions, under certain circumstances, to the distance limitations set forth in this section.
Why? Anderson contends that the distance limitations set forth in this section afford existing FM broadcast stations no leeway in relocating transmission facilities from aging towers or lost tower sites to existing towers.
The proposed new subsection would allow deviation from the spacing limitations set forth in subsection e, provided a showing is made that no greater interference will be caused to short-spaced stations than would occur at the minimum distances specified in this subsection.
The Media Bureau received two letters in support of the Petition and Amended Petition. One was sent to Audio Division head Al Shuldiner by Urban One President/CEO Alfred Liggins III, while the second came courtesy of Marble City Media President/CEO Lee Perryman.
Upon review, the Bureau said yes to Anderson’s request to open a rulemaking proceeding based on the Amended Petition, which is assigned as MB Docket No. 26-303.
