Sumner RedstoneThe lawsuit challenging the mental competency of Sumner Redstone can move forward, a judge ruled.

Until recently, the 92-year-old Redstone was executive chairman of CBS Corporation, parent of CBS Radio and Television. Redstone is now chairman emeritus and the company replaced him with Leslie Moonves.

Redstone’s former companion Manuela Herzer bought suit, claiming Redstone was not mentally competent when he removed her from a directive that would have given her his medical power of attorney and removed her from his estate plan, cutting her out from inheriting multi-million dollar homes, reported the New York Times.

Redstone attorneys say the suit is without merit and that Herzer wants money.
